Germany Plans to Legalize Home Cultivation and Possession of Cannabis as of April 1st, 2024

Germany plans that home cultivation and possession of certain amounts of cannabis will be allowed for adults as of April 1st, 2024, according to draft legislation accessed by the German news agency DPA.

Additionally, under legislative changes that have been under negotiation for months, joint cultivation in cannabis clubs and mutual supply between them will be possible as of July 1st. Those over the age of 18 will be able to possess a certain amount and a maximum of three plants will be allowed to be grown at home.

“In the negotiations we have agreed on a paradigm shift in drug policy with regard to cannabis, expressly recognizing the social reality,” the health spokespersons of the parliamentary groups of the Social Democratic Party (SPD), The Greens, and the Freedom Party (FDP), Heike Baehrens, Janosch Dahmen and Andrew Ullmann, respectively, have announced in Berlin.

The parties of the government coalition agreed on less strict rules for the possession and consumption of cannabis than initially planned, under pressure from Greens and Liberals. As a result, the amount allowed for home cultivation will be doubled from 25 to 50 grams. If possession limits are slightly exceeded, it will not be prosecuted as a criminal offense, explained the Greens’ health officer, Kirsten Kappert-Gonther. Initially, possession of more than 25 grams was to be considered a crime. Now it will be between 25 and 30 grams in public places and between 50 and 60 grams in private places. Possession would only be a crime with possible prison sentences if it exceeds that amount. Cannabis selling is still prohibited and the amount allowed for driving is still under analysis.

The Ministry of Transport will propose a THC limit value before the end of March. THC is the active ingredient of the cannabis plant. It was announced that the current total ban on driving under the influence of cannabis will be replaced by a regulation that, as in the case of alcohol, sets a THC blood limit. After the plans became known, various sources expressed their opposition to legalization.

“While Germany is going through a national crisis, the government parties are dealing with weed,” said the secretary general of the opposition conservative CSU party, Martin Huber.

“Cannabis use among young people will increase because this type of substance is always passed on to the youngest,” warned the president of the Professional Association of Pediatricians and Doctors for Adolescents, Thomas Fischbach, to the newspaper Die Welt.
