In April 2023, the German government agreed on a draft. This was presented by Federal Health Minister Lauterbach and Federal Agriculture Minister Özdemir. The intention was to avoid possible conflicts with the EU or other countries. Therefore, the original plans were revised.

The result is that the key points are no longer quite so far-reaching. The permitted amount for personal use was initially to be a maximum of 30 grams. It has now been lowered to 25 grams.

Cannabis cultivation and consumption

For private cultivation, the original plan for cannabis legalization remains in place. The key framework points are:

Three female flowering plants per adult person are allowed.
Children and adolescents are not allowed access.
Consumption is prohibited near schools and daycare centers.
There is a ban before 8 p.m. in pedestrian areas.
If minors are caught with cannabis, they must participate in so-called intervention and prevention programs.
Erasure of old convictions
The state also wants to use cannabis legalization to decriminalize the use of the intoxicant. Therefore, there will be the possibility to erase previous convictions from the Federal Central Register due to the new regulations.

This will have a positive effect on job applications. After all, many companies require an extract from the register. In this way, they want to ensure that applicants have a “clean slate.”

Ensuring controlled delivery

Dispensing is initially not allowed in licensed stores after cannabis legalization. Sales will take place in non-profit “cannabis clubs.”

In these “social clubs,” adults between the ages of 18 and 21 will be allowed to obtain a maximum of 25 grams in one purchase. They will be allowed to purchase 30 grams per month. Those who have reached the age of 21 will receive 25 grams per purchase, but a maximum of 50 grams per month.

What the key points presented prohibit, however, is consumption in clubrooms. This regulation is criticized by experts as out of touch with reality.

In the previous market, it was possible to buy medical cannabis, nutritional supplements, and wellness and cosmetic products containing CBD. After cannabis legalization, about four million adult cannabis users will be added. Legal sales will earn the companies involved billions of euros.

There will be medical use. Here, sales are made primarily through doctors and pharmacies.
